The Secretary of State for Trade and Industry, being a Minister designated( 1 ) for the purposes of section 2(2) of the European Communities Act 1972( 2 ) in relation to information society services, in exercise of the powers conferred on her by the said section 2(2), hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Electronic Commerce (EC Directive) (Extension) Regulations 2004 and shall come into force on 14 th May 2004.

Application of the E-Commerce Regulations

2.The Electronic Commerce (EC Directive) Regulations 2002( 3 ) shall apply to the Sexual Offences Act 2003( 4 ) notwithstanding regulation 3(2) of those Regulations.

Amendment of the E-Commerce Regulations

3. β€”(1)The Electronic Commerce (EC Directive) Regulations 2002 are amended as follows.

(2) For regulation 3(2) there is substituted–

β€œ (2) These Regulations shall not apply in relation to any Act passed on or after the date these Regulations are made or in relation to the exercise of a power to legislate after that date. ” .
