The Secretary of State for Work and Pensions, in exercise of the powers conferred upon him by sections 123(1)(e), 131(10), 137(1) and 175(1), (3) and (4) of the Social Security Contributions and Benefits Act 1992( 1 ) and all other powers enabling him in that behalf, after consultation with organisations appearing to him to be representative of the authorities concerned( 2 ) and after agreement by the Social Security Advisory Committee that proposals in respect of these Regulations need not be referred to it( 3 ), hereby makes the following Regulations:
Citation, commencement and interpretation
1. —(1) These Regulations may be cited as the Council Tax Benefit (Abolition of Restrictions) Regulations 2004 and shall come into force on 1st April 2004.
(2) In these Regulations—
“the Council Tax Benefit Regulations” means the Council Tax Benefit (General) Regulations 1992( 4 ).
Amendment of the Council Tax Benefit Regulations
2. —(1) The Council Tax Benefit Regulations are amended in accordance with the following provisions of this regulation.
(2) In regulation 2(1), omit the definition of “valuation band”.
(3) In regulation 51, omit paragraphs (2A) and (2B).
(4) In paragraph 1 of Schedule 2—
(a) in sub-paragraph (1), omit the words “sub-paragraphs (3) and (4) and”;
(b) omit sub-paragraphs (3) and (4).
Revocation
3.The Council Tax Benefit (General) Amendment Regulations 1997( 5 ), the Council Tax Benefit (General) Amendment Regulations 1998( 6 ), and regulation 9 of the Social Security (Welfare to Work) Regulations 1998( 7 ) are revoked.
