The Lord Chancellor and the Secretary of State, in exercise of the powers conferred upon them by section 125A(3) of the Magistrates' Court Act 1980( 1 ), hereby make the following Order:
Citation and commencement
1. This Order may be cited as the Magistrates' Courts Warrants (Specification of Provisions) (Amendment) Order 2004 and shall come into force on 1 st September 2004.
Amendment of the Magistrates' Courts Warrants (Specification of Provisions) Order 2000
2. —(1)The Magistrates' Courts Warrants (Specification of Provisions) Order 2000( 2 ) shall be amended as follows.
(2) For paragraphs(a) and (b) in article 2 there shall be substituted the following paragraphs–
“ (a) paragraph 7(2) of Schedule 7 to the Powers of Criminal Courts (Sentencing) Act 2000 ( 3 ) ;
(aa) section 7(1) of the Bail Act 1976 ( 4 ) ;
(b) in the Magistrates' Court Act 1980–
(i) section 1;
(ii) section 13;
(iii) section 76;
(iv) section 83(1) and (2);
(v) section 86(4);
(vi) section 93(5);
(vii) section 97;
(viii) section 97A ( 5 ) ;
(ix) section 136; ”
(3) For paragraph (d) in article 2 there shall be substituted the following paragraph–
“ (d) paragraph 4 of Schedule 3 to the Crime and Disorder Act 1998 ( 6 ) . ”
