CRIMINAL LAW, ENGLAND AND WALES

The Criminal Justice and Court Services Act 2000 (Commencement No. 13) Order 2004

The Secretary of State, in exercise of the powers conferred upon him by section 80(1) of the Criminal Justice and Court Services Act 2000( 1 ) hereby makes the following Order:

1. This Order may be cited as the Criminal Justice and Court Services Act 2000 (Commencement No. 13) Order 2004.

2. —(1) The provisions of the Criminal Justice and Court Services Act 2000 listed in paragraph (2) shall come into force on 2 nd September 2004.

(2) The provisions referred to in paragraph (1) are—

(a) section 46 (exclusion orders);

(b) section 52 (community sentences: electronic monitoring of requirements) to the extent that it is not already in force, save only in so far as it relates to exclusion requirements;

(c) section 74 (amendments) in so far as it relates to the provisions referred to in sub-paragraph (d);

(d) in Schedule 7 (minor and consequential amendments)

(i) paragraph 161 to the extent that it is not already in force;

(ii) paragraph 196 to the extent that it is not already in force, except for—

(aa) sub-paragraph (c)(iii); and

(bb) the references to paragraph 8 of Schedule 2 to the Powers of Criminal Courts (Sentencing) Act 2000( 2 );

(iii) in paragraph 197–

(aa) in sub-paragraph (f), the entries referring to an exclusion order; and

(bb) sub-paragraph (g) to the extent that it is not already in force;

(iv) in paragraph 199, sub-paragraphs (2), (5) and (21)(a) to (e) to the extent that they are not already in force.
