The Secretary of State for Transport, in exercise of the powers conferred upon him by sections 52(1) and 60(1)(e) and (1A) of the Public Passenger Vehicles Act 1981( 1 ), and after consultation with representative organisations in accordance with section 61(2) of that Act, hereby makes the following Regulations:

Citation, commencement and extent

1. —(1) These Regulations may be cited as the Public Service Vehicles (Registration of Local Services) (Amendment) (England and Wales) (No.2) Regulations 2004 and shall come into force on 1st October 2004.

(2) These Regulations extend to England and Wales( 2 ).

Amendment of the principal Regulations

2. —(1)The Public Service Vehicles (Registration of Local Services) Regulations 1986( 3 ) are amended as follows.

(2) In regulations 12(1)(a) and 12(2)(a) substitute “£11” for “£10”.

(3) In regulations 12(1)(b) and 12(2)(b) substitute “£45” for “£40”.

Section 52(1) was amended by the Transport Act 1985 (c. 67) (in the footnotes called “the 1985 Act”), sections 1(3), 3(5) and 139(3), and paragraph 7 of Schedule 1, paragraphs 4(1) and 4(14) of Part II of Schedule 2 and Schedule 8; by the Road Traffic (Driver Licensing and Information Systems) Act 1989 (c. 22) , section 16 and schedule 6; and by the Deregulation and Contracting Out Act 1994 (c. 40) ( in the footnotes called “the 1994 Act”), section 66; In section 60: subsection (1) was amended by the 1985 Act, sections 134 and 139, Schedule 7, paragraph 21(1) and (9), and Schedule 8, and by the 1994 Act, section 66(5), and subsection (1A) was inserted by the 1985 Act, section 134(2). Section 61(2) was amended by the 1985 Act, section 139(3) and Schedule 8. Section 52 was applied to fees for the registration of local services by section 126(1) of the 1985 Act and sections 60 and 61 have effect by virtue of sections 134 and 135 of the 1985 Act as if Part I of the 1985 Act was incorporated in the 1981 Act. For the definition of “prescribed” see section 60(2) of the 1981 Act.

Competence to make regulations in respect of Scotland has been devolved by virtue of the Scotland Act 1998 (c. 46) , section 53.
