The First Secretary of State, in exercise of the powers conferred upon him by sections 59 and s.333(7) of the Town and Country Planning Act 1990( 1 ) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, application and commencement

1. —(1) This Order may be cited as the Town and Country Planning (London Borough of Camden) Special Development (Amendment) Order 2004 and shall come into force on 6th October 2004.

(2) This Order applies to land within the designated area.

Interpretation

2. In this Order—

the 2004 Order” means the Town and Country Planning (London Borough of Camden) Special Development Order 2004 ( 2 ) and expressions used in this Order shall have the meaning which they bear in the 2004 Order.

Amendment of the 2004 Order

3. In article 4 of the 2004 Order (publicity for applications for planning permission)—

(a) for “paragraphs (2) to (5)” substitute “paragraphs (2) to (6)”;

(b) after paragraph (5) of the paragraphs inserted into the 1995 Order insert—

(6) Where the notice is, without any fault or intention of the local planning authority, removed, obscured or defaced before the period of 21 days referred to in paragraph (3)(a), (3A)(a), (4)(a) or (5)(a) has elapsed, the local planning authority shall be treated as having complied with the requirements of the relevant paragraph if they have taken reasonable steps for protection of the notice and, if need be, its replacement .

The functions of the Secretary of State under sections 59 and 333(7) were, so far as exercisable in relation to Wales transferred to the National Assembly for Wales by article 2 of and Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672 : see the entry in Schedule 1 for the Town and Country Planning Act 1990 (c. 8) , as substituted by article 4 of, and Schedule 3 to, the National Assembly for Wales (Transfer of Functions) Order, S.I. 2000/253 .
