Coming into force in accordance with article 1

The Secretary of State for Transport makes this Instrument in exercise of powers conferred by section 106(3) of the Highways Act 1980( 1 ) and now vested in him( 2 ) and of all other powers enabling him in that behalf:

1. This Instrument may be cited as The Wigan Borough Council (Henhurst Canal Bridge) Scheme 2003 Confirmation Instrument 2004 and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

2. The Wigan Borough Council (Henhurst Canal Bridge) Scheme 2003 (“the Scheme”) is hereby confirmed without modifications.

3. The Scheme as confirmed is set out in the Schedule hereto (including the plans) and copies of the Scheme with its accompanying plans are deposited at the offices of the Department for Transport, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA, and at the offices of Wigan Borough Council, The Town Hall, Library Street, Wigan WN1 1YN.

THE SCHEDULE THE WIGAN BOROUGH COUNCIL (HENHURST CANAL BRIDGE) SCHEME 2003

The Wigan Borough Council (hereinafter referred to as “the Council”) make this Scheme in exercise of their powers under section 106(3) of the Highways Act 1980 and of all other powers enabling them in that behalf.

1. The Council are authorised to construct over the navigable waters of the Leeds and Liverpool Canal the bridge specified in the Schedule to this Scheme as part of the highway known as the B5238 Chapel Lane/Poolstock which they are proposing to improve between Wood Street and Corporation Street in the area of Poolstock in the Borough of Wigan.

2. This Scheme may be cited as the Wigan Borough Council (Henhurst Canal Bridge) Scheme 2003.

THE SCHEDULE TO THE SCHEME

Plans and Specifications of the Henhurst Canal Bridge

The location and general design of the Bridge are shown on the plans numbered Plan 1 and Plan 2 marked “The Wigan Borough Council (Henhurst Canal Bridge) Scheme 2003”.

Points of Commencement and Termination

From a point on the north bank of the Leeds Liverpool (West) Canal 20.0 metres south of the junction of Chapel Lane with Green Street.

To a point on the south bank of the Leeds Liverpool (West) Canal 41.0 metres south of the junction of Chapel Lane with Green Street.

Span

Single span bridge. Clear span between faces of abutments of 21 metres.

Headway

Not less than 4.0 metres above nominal water level of 27.272 AOD and not less than 2.5 metres above the towpath which runs alongside the north bank of the Canal.

Waterway

A minimum clear navigable waterway of 5.0 metres.

Overall Dimensions

The Bridge will carry 2 footways, 2 cycle lanes and a dual carriageway comprising 5 lanes and a central reserve.

The Bridge will be 27.40 metres wide overall and will carry a 20.4 metre wide dual carriageway incorporating a 2.75 metre central reserve, a footway of 1.4 metres width on either side and a cycle lane of 1.6 metres width on either side.

The wingwalls are 0.5 metres wide on either side.
