The Secretary of State, being a Minister designated for the purposes of section 2(2) of the European Communities Act 1972( 1 ) in relation to measures relating to the organisation of working time( 2 ), in exercise of the powers conferred upon her by that provision, hereby makes the following Regulations:

Citation, commencement and interpretation

1. β€”(1) These Regulations may be cited as The Working Time Regulations 1998 (Amendment) Regulations 2004 and shall come into force on 1st October 2004.

(2) In these Regulations, β€œthe Principal Regulations” means The Working Time Regulations 1998( 3 ).

Amendments to the Principal Regulations

2. After paragraph (6) of regulation 35 (restrictions on contracting out) of the Principal Regulations insertβ€”

β€œ (6A) A person shall be treated as being a qualified lawyer within paragraph (6)(a) if he is a Fellow of the Institute of Legal Executives employed by a solicitors' practice. ” .
