The Secretary of State for Health, in exercise of the powers conferred on him by section 22(1) and (2) of the Health and Social Care (Community Health and Standards) Act 2003( 1 ), and of all other powers enabling him in that behalf, hereby makes the following Order:
Citation, commencement and interpretation
1. β(1) This Order may be cited as the Cambridge University Hospitals National Health Service Foundation Trust (Trust Funds: Appointment of Trustees) Order 2004 and shall come into force on 30th September 2004.
(2) In this Orderβ
βthe Actβ means the Health and Social Care (Community Health and Standards) Act 2003; and
βthe Trustβ means the Cambridge University Hospitals National Health Service Foundation Trust( 2 ).
Appointment of trustees
2. β(1) The Secretary of State shall appoint trustees for the Trust for the purpose of exercising the functions described in section 22(1) of the Act (trust funds and trustees).
(2) The appointment of any such trustee shall be for such period, not exceeding 4 years, as the Secretary of State may specify on making the appointment.
Termination and suspension of appointment
3. Where the Secretary of State is of the opinion that it is not in the interests of the Trust or the health service that a trustee for the Trust should continue to hold that office, he may forthwith terminate the appointment and, pending his decision, may suspend any such trustee from such office.
