The Secretary of State for Health, in exercise of the powers conferred upon him by section 201(1) of the Health and Social Care (Community Health and Standards) Act 2003( 1 ), and all other powers enabling him in that behalf, hereby makes the following Order:
Citation, commencement and interpretation
1. —(1) This Order may be cited as the Health and Social Care (Community Health and Standards) Act 2003 (Consequential Provisions – Appointments) Order 2004 and shall come into force on 5th November 2004.
(2) In this Order, the “2002 Order” means the General Dental Council (Constitution) Order 2002( 2 ).
Amendment of the 2002 Order
2. —(1) The 2002 Order is amended in accordance with this article.
(2) For article 3 (appointment of lay members) of the 2002 Order, substitute—
“ 3. The Privy Council may appoint as lay members persons whom the Privy Council considers to have such qualifications or experience as will be of value to the new Council in the performance of their duties. ”
(3) In article 3B (termination of office) of the 2002 Order, in paragraph (1)(c), for the words “Her Majesty, on the advice of Her Privy Council,” substitute “the Privy Council”.
