The Secretary of State and the Department of Agriculture and Rural Development, acting jointly in exercise of their powers under section 19(4)(e) of the Veterinary Surgeons Act 1966( 1 ) and now vested in them and after consultation with the Council of the Royal College of Veterinary Surgeons make the following Order:
Title and commencement
1. This Order may be cited as the Veterinary Surgery (Vaccination Against Foot-And-Mouth Disease) Order 2004 and comes into force on 1st December 2004.
Exemption from the prohibition on the practice of veterinary surgery
2. โ(1) The vaccination of animals against foot-and-mouth disease is a minor treatment for the purposes of section 19(4)(e) of the Veterinary Surgeons Act 1966 if the person administering the vaccine complies with this article.
(2) He must be 18 years of age or over.
(3) He must act under the direction of a veterinary surgeon.
(4) He must obtain a certificate of competence from a veterinary surgeon.

1966 c. 36 . โThe Ministersโ are defined in section 27(1)(as amended by S.I. 1978/272 , article 11 and Sch. 5). The functions of the Minister of Agriculture, Fisheries and Food under the Act were transferred to the Secretary of State for Environment, Food and Rural Affairs by the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002, S.I. 2002/794 . See also paragraph 4(1)(b) of the Schedule to the Northern Ireland Act 2000 (c. 1) , which has effect during suspension pursuant to section 1(8) of that Act: this paragraph provides that the functions of a Northern Ireland Minister who was in charge of a Northern Ireland Department immediately before the coming into force of section 1 of the Act may be discharged by that Department, subject, according to paragraph 4(1)(f) of the Schedule, to the direction and control of the Secretary of State. The Department of Agriculture for Northern Ireland was renamed the Department of Agriculture and Rural Development by article 3(4) of the Departments (Northern Ireland) Order 1999 ( S.I.1999/283 (N.I.1) ).
