The First Secretary of State, in exercise of the powers conferred by sections 45(1)(d) and (9) of the Local Government Finance Act 1988( 1 ), hereby makes the following Regulations:
Citation, application and commencement
1. These Regulations, which apply to England only, may be cited as the Non-Domestic Rating (Unoccupied Property) (England) (Amendment) Regulations 2004 and shall come into force on 1st April 2005.
Property liable for unoccupied property rates
2. In respect of a hereditament shown in a non-domestic rating list compiled on or after 1st April 2005, in regulation 2(2)(g) of the Non-Domestic Rating (Unoccupied Property) Regulations 1989( 2 ) for “£1,900” substitute “£2,200”.
Revocation
3.The Non-Domestic Rating (Unoccupied Property) (Amendment) Regulations 1995( 3 ) are revoked.

1988 c. 41 . Section 45 was amended by sections 79(3) and 139 of and paragraph 23 of Schedule 5 to the Local Government and Housing Act 1989 (c. 42) . These powers were devolved, in relation to Wales, to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672 ); see the reference to the Local Government Finance Act 1988 in Schedule 1.
