The First Secretary of State, in exercise of the powers conferred upon him by sections 21, 91 and 93 of the Planning (Listed Buildings and Conservation Areas) Act 1990( 1 ) hereby makes the following Regulations:

Citation, commencement and application

1. —(1) These Regulations may be cited as the Planning (Listed Buildings and Conservation Areas) (Amendment) (No. 2) (England) Regulations 2004 and shall come into force on 14th January 2005.

(2) These Regulations apply in relation to England only.

Amendments to the Planning (Listed Buildings and Conservation Areas) Regulations 1990

2. In the following provisions of the Planning (Listed Buildings and Conservation Areas) Regulations 1990( 2 ), for “three” substitute “six”—

(a) regulation 8(1) (appeals); and

(b) Parts I, II and III of Schedule 1 (notices to be sent to applicant).

1990 c. 9 . The functions of the Secretary of State under section 21 of the Planning (Listed Buildings and Conservation Areas) Act 1990 are, so far as exercisable in relation to Wales, exercisable by the National Assembly for Wales by virtue of the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672 : see article 2 and the entry in Schedule 1 for the 1990 Act.
