The Secretary of State for Health, in exercise of the powers conferred upon him by section 6(5) of the Carers (Equal Opportunities) Act 2004( 1 ), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Carers (Equal Opportunities) Act 2004 (Isles of Scilly) Order 2005 and shall come into force on 28th April 2005.

Application of section 3 of the Carers (Equal Opportunities) Act 2004 to the Isles of Scilly

2.Section 3 of the Carers (Equal Opportunities) Act 2004(co-operation between authorities) shall, in its application to the Isles of Scilly, have effect with the modifications thatβ€”

(a) except for the reference in subsection (5)(a), any reference to a local authority shall, in relation to the Isles of Scilly, be construed as a reference to the Council of the Isles of Scilly;

(b) subsection (5)(a) shall, in relation to a request made by the Council of the Isles of Scilly, have effect as if the word β€œother” is omitted; and

(c) in relation to a request made by a local authority, the list of authorities in subsection (5) shall be construed as including the Council of the Isles of Scilly.
