The Secretary of State for Transport makes this scheme in exercise of powers conferred by sections 16, 17 and 19 of the Highways Act 1980( 1 ) and now vested in him( 2 ), and of all other powers enabling him in that behalf:

1. This scheme may be cited as the M40 Motorway Junction 4 (Handy Cross) Connecting Road Scheme 2005 and shall come into force on 3rd May 2005.

2. The Secretary of State is authorised to provide the special road for the exclusive use of traffic of Classes I and II of the classes of traffic set out in Schedule 4 to the Highways Act 1980 along a route from the point marked A on the plan referred to at Article 3 below to a point marked B on the said plan at Wycombe in the County of Buckinghamshire, a distance of 0.62 kilometres.

3. The centre line of the special road is indicated by a heavy black line on the plan numbered HA 16/MP/003 marked “The M40 Motorway Junction 4 (Handy Cross) Connecting Road Scheme 2005, signed by authority of the Secretary of State for Transport and deposited at ODPM-DfT Records Management Branch, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA.

4. The new special road shall become a trunk road on the date when this Scheme comes into force.
