The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by sections 41(1), (2)(b) and (5) of the Road Traffic Act 1988( 1 ).

In accordance with section 195(2) of that Act he has consulted such representative organisations as he thinks fit.

Citation and commencement

1. These Regulations may be cited as the Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) (Amendment) (No. 4) Regulations 2005 and shall come into force on 13th December2005.

Modification of the Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) Regulations

2. —(1) At the beginning of regulation 14 of the Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification ) Regulations 1981( 2 ), the words “Subject to paragraph 3A of Schedule 2,” shall be inserted.

(2) In Schedule 2 of those Regulations, the following paragraph shall be inserted after paragraph 3—

3A. Regulation 14 (exhaust pipe) shall not apply in the case of a steam-powered vehicle which was manufactured before 1st January 1955, whether or not it has subsequently been used as a public service vehicle. .
