The Serious Organised Crime and Police Act 2005 (Commencement No.3) Order 2005

9th November 2005
The Secretary of State, in exercise of the powers conferred upon him by—
section 178(7) of the Serious Organised Crime and Police Act 2005( 1 ) as respects the provisions brought into force by article 2 of this Order, after consulting the Scottish Ministers, and
section 178(8) of that Act as respects the other provisions brought into force by this Order,
makes the following Order.
1. —(1) This Order may be cited as the Serious Organised Crime and Police Act 2005 (Commencement No.3) Order 2005.
(2) In this Order “the Act” means the Serious Organised Crime and Police Act 2005.
2. The following provisions of the Act shall come into force on 1st January 2006—
(a) section 98(2) (civil recovery: freezing orders: Scotland);
(b) paragraphs 1 and 6 of Schedule 6 (minor and consequential amendments relating to Chapter 6 of Part 2), and
(c) section 109 so far as relating to those paragraphs.
3. The following provisions of the Act shall come into force on 1st January 2006—
(a) section 98(1) (civil recovery: freezing orders: England, Wales and Northern Ireland);
(b) section 109 (minor and consequential amendments relating to Chapter 6 of Part 2) to the extent not already in force; and
(c) paragraphs 2, 3, 5, 7 to 19, 21 to 23 of Schedule 6 (minor and consequential amendments relating to Chapter 6 of Part 2).
