The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 11(1) and (2) and 13(1) of the Railways and Transport Safety Act 2003

Citation and commencement

1. These Regulations may be cited as the Railways (Accident Investigation and Reporting) (Amendment) Regulations 2005 and shall come into force on 11th January 2006.

Amendment of the Railways (Accident Investigation and Reporting) Regulations 2005

2. —(1)The Railways (Accident Investigation and Reporting) Regulations 2005 shall be amended as follows.

(2) In regulation 2(1), after the definition of “Safety Directive” insert— “ “working days” shall be taken to exclude Saturdays, Sundays, Christmas Day, Good Friday and, in relation to an accident or incident that occurs in England and Wales, any day which, under the Banking and Financial Dealings Act 1971 , is a bank holiday in England and Wales, in relation to an accident or incident that occurs in Scotland, any other day which, under that Act, is a bank holiday in Scotland and, in relation to an accident or incident that occurs in Northern Ireland, any day which, under that Act, is a bank holiday in Northern Ireland.“ ”

(3) In regulation 12(4), before “determine” insert “reasonably”.
