The Disability Discrimination Code of Practice (Public Authorities) (Duty to Promote Equality) (Appointed Day) Order 2005

The Secretary of State for Work and Pensions, in exercise of the power conferred upon him by section 53A(6)(a) of the Disability Discrimination Act 1995( 1 ), after consultation with the National Assembly for Wales and the Scottish Ministers, makes the following Order:
Citation
1. This Order may be cited as the Disability Discrimination Code of Practice (Public Authorities) (Duty to Promote Equality) (Appointed Day) Order 2005.
Appointed Day
2. 5th December 2005 is the day appointed for the coming into effect of the Code of Practice laid before Parliament in draft on 25th October 2005 and issued by the Disability Rights Commission under section 53A(1C) of the Disability Discrimination Act 1995( 2 ), entitled βThe Duty to Promote Disability Equality: Statutory Code of Practice (England and Wales)β( 3 ).

1995 c. 50 . Section 53A was inserted by the Disability Rights Commission Act 1999 (c. 17) , section 9(1), and is amended by the Special Educational Needs and Disability Act 2001 (c. 10) , section 36, S.I. 2003/1673 , and the Disability Discrimination Act 2005 (c. 13) (βthe 2005 Actβ), section 16(2) and paragraph 28 of Schedule 1. The requirement to consult the National Assembly for Wales and the Scottish Ministers before appointing a day is imposed by subsection (6A), inserted by paragraph 28(5) of Schedule 1 to the 2005 Act.
Subsection (1C) was inserted by paragraph 28(3) of Schedule 1 to the 2005 Act.
