The Water Act 2003 (Commencement No. 3) (England) Order 2005

The Secretary of State, in exercise of the powers conferred upon him by sections 105(3), (4) and (6) of the Water Act 2003 ( 1 ) hereby makes the following Order:

Citation and interpretation

1. —(1) This Order may be cited as the Water Act 2003 (Commencement No. 3) (England) Order 2005.

(2) In this Order “the Act” means the Water Act 2003 .

(3) Unless the contrary intention appears, any reference in this Order to a section is a reference to a section of the Act.

Provisions coming into force on 18th February 2005

2. The following provisions of the Act shall come into force on 18th February 2005 in so far as they apply to England—

Section 58(5), (6) and (8), in so far as it has effect for the purpose of inserting into the WIA( 2 ) section 89(1)(a) and (b), (2)(b) and (d), (3), (5)(b) and section 90(3) and section 58(1) in so far as it relates thereto, only for the purpose of enabling the Secretary of State to make regulations in relation to England.
