The Secretary of State, in exercise of the powers conferred upon her by section 84(1) of the Animal Health Act 1981( 1 ), and with the approval of the Treasury, makes the following Order:
Title, commencement and application
1. This Order may be cited as the Diseases of Animals (Fees for the Testing of Disinfectants) (England) Order 2005, comes into force on 1st April 2005 and applies to England only.
Fees for the testing of disinfectants
2. A person who submits a disinfectant for testing under article 7 of the Diseases of Animals (Approved Disinfectants) Order 1978( 2 ) shall, when he submits the disinfectant for testing, pay to the Secretary of State the fees set out in the Schedule to this Order.
Revocation
3. The Diseases of Animals (Fees for the Testing of Disinfectants) Order 1991( 3 ) is revoked insofar as it applies to England.

1981 c. 22 ; see section 86(1) for definitions of “the Minister” and “the Ministers”. Functions of “the Ministers”, so far as exercisable in relation to England, were transferred to the Minister of Agriculture, Fisheries and Food by the Transfer of Functions (Agriculture and Food) Order 1999 ( S.I. 1999/3141 ) and to the Secretary of State by the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002 ( S.I. 2002/794 ).
