The Secretary of State, in exercise of the powers conferred upon him by sections 12(2), 15(3), 16(3) and 118(5) and (6) of the Care Standards Act 2000( 1 ) and section 87D(2) of the Children Act 1989( 2 ), and of all other powers enabling him in that behalf, hereby makes the following Regulations:β€”

Citation, commencement, application and interpretation

1. β€”(1) These Regulations may be cited as the Commission for Social Care Inspection (Fees and Frequency of Inspections) (Amendment) Regulations 2005 and shall come into force on 1st April 2005.

(2) These Regulations apply in relation to England only.

(3) In these Regulations, β€œthe principal Regulations” means the Commission for Social Care Inspection (Fees and Frequency of Inspections) Regulations 2004( 3 ).

Amendment of regulation 3 of the principal Regulations

2.Regulation 3 of the principal Regulations (registration fees) is amended as followsβ€”

(a) in paragraph (1)(a), for β€œΒ£1,584” substitute β€œΒ£1,901”;

(b) in paragraph (1)(b), for β€œΒ£1,320” substitute β€œΒ£1,584”;

(c) in paragraph (2)(a), for β€œΒ£432” substitute β€œΒ£518”;

(d) in paragraph (2)(b), for β€œΒ£360” substitute β€œΒ£432”;

(e) in paragraph (3)(a), for β€œΒ£432” substitute β€œΒ£518”; and

Amendment of regulation 4 of the principal Regulations

3.Regulation 4 of the principal Regulations (variation fees) is amended as followsβ€”

(b) in paragraph (1)(b), for β€œΒ£660” substitute β€œΒ£792”;

(c) in paragraph (2)(a), for β€œΒ£432” substitute β€œΒ£518”;

Amendment of regulation 5 of the principal Regulations

4. β€”(1)Regulation 5 of the principal Regulations (annual fees) is amended in accordance with the following paragraphs of this regulation.

The functions of the National Care Standards Commission under Part 2 have been transferred either to the Commission for Healthcare Audit and Inspection or to the Commission for Social Care Inspection in accordance with section 102 of the 2003 Act with effect from 1st April 2004.
