The Merchant Shipping (Fees) (Amendment) Regulations 2005

The Secretary of State for Transport, in exercise of the powers conferred upon him by section 302 of the Merchant Shipping Act 1995( 1 ) and with the consent of the Treasury, hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Merchant Shipping (Fees) (Amendment) Regulations 2005 and shall come into force on 1st April 2005.

Amendments to the Merchant Shipping (Fees) Regulations 1996

2. —(1) The Merchant Shipping (Fees) Regulations 1996( 2 ) are amended as follows.

(2) In regulation 5(2), for the words following “the hourly rate of” there is substituted “£36”.

(3) In the Schedule, in Part I—

(a) in paragraph 2(2)(a), for the words following “the hourly rate of” there is substituted “£36”; and

(b) in paragraph 2(2)(b) for “£50” there is substituted “£75”.

(4) In Part XII, for the table there is substituted:

Radio surveys per hour, or part thereof Other surveys, inspections and tests per hour or part thereof
1 For waiting time prior to the commencement of and during the course of a survey or inspection
for a period not in excess of one hour No fee No fee
For periods in excess of one hour
for surveys in the United Kingdom £36.00 £78.00
for surveys abroad £72.00 £156.00
2 For abortive visits in the United Kingdom: for the time wasted in excess of one hour at the place of survey or inspection plus the time occupied in travelling to and from the place of survey £36.00 £78.00
3 Where a surveyor or inspector is called upon to perform services at unusual hours; for work undertaken during the following times including time occupied in travelling:
Mondays to Fridays inclusive between 6pm and 8am and all day Saturday £18.00 £39.00
Sunday and Public Holidays £36.00 £78.00
