The Secretary of State for Health in exercise of the powers conferred upon him by section 200(1) and 201(1) of the Health and Social Care (Community Health and Standards) Act 2003( 1 ) and of all other powers enabling him in that behalf, after consulting the National Assembly for Wales in accordance with section 199(2)(b)(iv) of that Act, hereby makes the following Order:β
Citation, commencement and interpretation
1. β(1) This Order may be cited as the Health and Social Care (Community Health and Standards) Act 2003 (Commission for Healthcare Audit and Inspection) (Transitional Provisions) Order 2005 and shall come into force on 31 st March 2005.
(2) In this Orderβ
βthe Actβ means the Health and Social Care (Community Health and Standards) Act 2003;
βthe CHIβ means the Commission for Health Improvement( 2 ).
CHI β Accounts
2. β(1) The CHAI must prepare the annual accounts of the CHI in respect of the year beginning on 1 st April 2003 and ending on 31 st March 2004 in such form as the Secretary of State may determine.
(2) The CHAI must send copies of those annual accounts to the Secretary of State and the Comptroller and Auditor General within such period as the Secretary of State may determine.
(3) The Comptroller and Auditor General must examine, certify and report on those annual accounts and must lay copies of those accounts and of his report before Parliament.

The CHI was established by section 19 of the Health Act 1999 (c. 8) , and abolished by section 44 of the Act.
