The Crime (Sentences) Act 1997 (Commencement No.4) Order 2005

The Secretary of State, in exercise of the powers conferred upon him by section 57(2) and (3) of the Crime (Sentences) Act 1997( 1 ) hereby makes the following Order:

1. This Order may be cited as the Crime (Sentences) Act 1997 (Commencement No.4) Order 2005.

2. —(1) Subject to paragraph (3) the provisions of the Crime (Sentences) Act 1997 Act listed in paragraph (2) shall come into force on 4 th April 2005.

(2) The provisions referred to in paragraph (1) are—

(a) section 56(2) in so far as it relates to the provision mentioned in sub-paragraph (b);

(b) in Schedule 6 (repeals) the entry relating to section 67 of the Criminal Justice Act 1967( 2 ).

(3) The commencement of the provisions referred to in paragraph (2) is of no effect in a case in which a court has imposed a sentence of imprisonment in respect of an offence committed before 4 th April 2005 (whether or not it has also imposed a sentence of imprisonment in respect of an offence committed after that date).
