The Secretary of State, in exercise of the powers conferred upon him by sections 15(1) and 80 of the Health and Safety at Work etc. Act 1974( 1 )β€”

(a)

for the purposes of giving effect to proposals submitted to him by the Health and Safety Commission under section 11(2)(d) of the 1974 Act after the carrying out by the said Commission of consultations in accordance with section 50(3) of that Act; and

(b)

it appearing to him that the modifications in regulation 2 are expedient and it also appearing to him that there are no bodies to consult in respect of such modifications in accordance with section 80(4) of the 1974 Act,

hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Railways and Other Guided Transport Systems (Safety) (Amendment) Regulations 2006 and shall come into force as respects all regulations except for regulation 2(3) on 10th April 2006 and as respects regulation 2(3) on 1st October 2006.

Amendment of the Railways and Other Guided Transport Systems (Safety) Regulations 2006

2. β€”(1)Paragraph 4 of Schedule 6 to the Railways and Other Guided Transport Systems (Safety) Regulations 2006( 2 ) shall be amended as follows.

(2) After sub-paragraph (2) addβ€”

β€œ (a) at the end, add β€œParts 2 and 3 of the Railways and Other Guided Transport Systems (Safety) Regulations 2006.”; ” .

(3) After sub-paragraph (2)(a) addβ€”

β€œ (b) omit β€œRailways (Safety Case) Regulations 2000.”. ” .
