The Environmental Stewardship (England) and Organic Products (Amendment) Regulations 2006

The Secretary of State for Environment, Food and Rural Affairs makes the following Regulations under the powers conferred on him by section 2(2) of the European Communities Act 1972 and, in relation to the Environmental Stewardship (England) Regulations 2005 , under the powers conferred on him by section 98 of the Environment Act 1995 .

He has been designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to the common agricultural policy of the European Community.

In accordance with section 98 of the Environment Act 1995, he has obtained the consent of the Treasury.

In accordance with section 99 of the Environment Act 1995, he has consulted the Countryside Agency, English Nature and the Historic Buildings and Monuments Commission for England.

Title, commencement and application

1. —(1) These Regulations may be cited as the Environmental Stewardship (England) and Organic Products (Amendment) Regulations 2006 and come into force on 4 th September 2006.

(2) Subject to paragraph (3) these Regulations apply in relation to the United Kingdom.

(3) Regulation 3 applies in relation to England only.

Amendments to the Environmental Stewardship (England) Regulations 2005

3.Regulation 2 (interpretation) of the Environmental Stewardship (England) Regulations 2005 is amended as follows—

(a) in the definition of “Council Regulation”, for “as last amended by Commission Regulation “ as last amended by Commission Regulation ; and

(b) in the definition of “Compendium of UK Organic Standards”, for “July 2005” substitute “ September 2006 ” .

Revocation

4.The Environmental Stewardship (England) and Organic Products (Amendment) Regulations 2005 are revoked.
