The Education (National Curriculum) (Exceptions at Key Stage 4) (Revocation and Savings) (England) Regulations 2006

These Regulations are made in exercise of the powers conferred by sections 91, 96 and 210 of the Education Act 2002( 1 ).

In accordance with subsection (2) of section 96, the Secretary of State has referred a proposal to make these Regulations to the Qualifications and Curriculum Authority (“QCA”)( 2 ) and in accordance with subsection (3) of that section, the QCA has given notice of the proposal to the associations, bodies, organisations, and persons referred to in that subsection and given them a reasonable opportunity of submitting evidence and representations as to the issues arising;

In accordance with directions given by the Secretary of State under subsection (2) of section 96, the QCA has submitted its report to the Secretary of State containing the matters referred to in subsection (4) of that section;

After submitting its report to the Secretary of State, the QCA has arranged for it to be published in accordance with subsection (5) of that section;

The Secretary of State has published a draft of these Regulations and sent copies of them to the QCA and all those who were consulted by the QCA in accordance with subsection (6) of section 96, and has allowed a period of not less than one month for the submission of evidence and representations as to the issues arising in accordance with subsection (7) of that section;

Accordingly, the Secretary of State for Education and Skills makes without modification the following Regulations:

Citation, commencement and application

1. —(1) These Regulations may be cited as the Education (National Curriculum) (Exceptions at Key Stage 4) (Revocation and Savings) (England) Regulations 2006 and come into force on 9th October 2006.

(2) These Regulations apply to maintained schools in England.

Interpretation

2. In these Regulations

the 2003 Regulations” means the Education (National Curriculum) (Exceptions at Key Stage 4) (England) Regulations 2003( 3 );

the 2004 Regulations” means the Education (National Curriculum) (Exceptions at Key Stage 4) (England) (Amendment) Regulations 2004( 4 ).

Revocation

3. The 2004 Regulations, and subject to regulation 4, the 2003 Regulations, are revoked.—

Savings

4. The 2003 Regulations and any disapplication relating to science under them shall continue to apply in respect of a pupil—

(a) who immediately before 1st September 2006 was in the fourth key stage; and

(b) to whom the provisions of the National Curriculum relating to science do not apply under the 2003 Regulations.
