The Special Trustees for the Queen’s Medical Centre, Nottingham, University Hospital National Health Service Trust (Transfer of Trust Property) Order 2006

The Secretary of State for Health makes the following Order in exercise of the powers conferred on her by sections 92(6) and 126(4) of the National Health Service Act 1977( 1 ). It appears to her that the functions of the Special Trustees for the Queen’s Medical Centre, Nottingham, University Hospital National Health Service Trust should be discharged by the trustees for Nottingham University Hospitals National Health Service Trust( 2 ) and the Special Trustees and the new trustees have been consulted in accordance with the said section 92(6).

Citation, commencement and interpretation

1. —(1) This Order may be cited as the Special Trustees for the Queen’s Medical Centre, Nottingham, University Hospital National Health Service Trust (Transfer of Trust Property) Order 2006 and shall come into force on 6th November 2006.

(2) In this Order—

the Special Trustees” means the Special Trustees for the Queen’s Medical Centre, Nottingham, UniversityHospitalNational Health Service Trust;

the new trustees” means the trustees for the Nottingham UniversityHospitalsNational Health Service Trust; and

the trust property” means the property specified in the schedule of trust property prepared and agreed by the Special Trustees and the new trustees and signed on behalf of the Special Trustees and the new trustees on 26 th September 2006.

Transfer of trust property

2. —(1) On the date that this Order comes into force the trust property, and any rights and liabilities arising from that property, shall be transferred from the Special Trustees to the new trustees.

(2) In any instrument relating to the trust property, any reference to the name by which the trustees of the trust property are to be known shall be construed as a reference to the new trustees and any reference to the Special Trustees in the name by which the charitable trust governing the trust property is to be known shall be construed as a reference to the new trustees.
