The Secretary of State makes the following Order in exercise of the powers conferred by section 95 of the Local Government Act 2003( 1 ).

Citation and commencement

1. This Order may be cited as the Local Government (Best Value Authorities) (Power to Trade) (Amendment) (England) Order 2006 and shall come into force on 15th December 2006.

Amendment of the Local Government (Best Value Authorities) (Power to Trade) (England) Order 2004

2. —(1)The Local Government (Best Value Authorities) (Power to Trade) (England) Order 2004( 2 ) is amended as follows.

(2) For article 1(2)(b) substitute—

by virtue of such order as may from time to time be made by the Secretary of State under section 99(4) of the Local Government Act 2003 are within one of the following categories—

(i) “excellent”;

(ii) “good”;

(iii) “fair”;

(iv) “4 stars”;

(v) “3 stars”;

(vi) “2 stars”; or

(vii) “1 star”.
