The Secretary of State makes the following Order in exercise of the powers conferred by section 27 of the Further and Higher Education Act 1992( 1 ) (βthe Actβ).
In accordance with section 51 of the Act, he has received a proposal for the dissolution of the further education corporation known as Newark and Sherwood College ( 2 ) (βthe corporationβ) from the Learning and Skills Council for England.
In accordance with section 27(7)(a) of the Act, he has consulted the corporation. In accordance with section 27(2), the Order is made with the consent of the further education corporation known as Lincoln College ( 3 ) (βLincoln Collegeβ).
1. This Order may be cited as the Newark and Sherwood College (Dissolution) Order 2006 and comes into force on 1st January 2007.
2. On 1st January 2007 the corporation shall be dissolved and all of its property, rights and liabilities shall be transferred to Lincoln College, being a body corporate established for purposes which include the provision of educational facilities or services.
3. Section 26(2), (3) and (4) of the Act shall apply to any person employed by the corporation immediately before 1st January 2007 as if the references in that sectionβ
(a) to a person to whom that section applies were to a person so employed;
(b) to the operative date were to 1st January 2007;
(c) to the transferor were to the corporation; and
(d) to the corporation were to Lincoln College.
