The Social Security (Bulgaria and Romania) Amendment Regulations 2006

The Secretary of State for Work and Pensions makes the following Regulations in exercise of the powers conferred by sections 123(1)(a), (d) and (e), 131(3)(b), 135(1) and (2), 137(1) and (2) and 175(1) and (3) of the Social Security Contributions and Benefits Act 1992( 1 ), sections 4(5) and (12), 35(1) and 36(2) of, and paragraph 11 of Schedule 1 to, the Jobseekers Act 1995( 2 ) and sections 1(5)(a) and 17(1) of the State Pension Credit Act 2002( 3 ).

He has consulted with organisations which appear to him to be representative of the authorities concerned with these Regulations in so far as they relate to housing benefit and council tax benefit( 4 ).

The Social Security Advisory Committee has agreed that the proposals to make these Regulations should not be referred to it( 5 ).

Citation and commencement

1. These Regulations may be cited as the Social Security (Bulgaria and Romania) Amendment Regulations 2006 and shall come into force on 1st January 2007 (immediately after the Accession (Immigration and Worker Authorisation) Regulations 2006( 6 ) come into force).

Amendment of the Income Support (General) Regulations 1987

2. —(1)The Income Support (General) Regulations 1987( 7 ) are amended as follows.

(2) In regulation 21AA(4) (special cases: supplemental – persons from abroad), for sub-paragraph (f) substitute—

(f) a person who is treated as a worker for the purpose of the definition of “qualified person” in regulation 6(1) of the Immigration (European Economic Area) Regulations 2006 ( 8 ) pursuant to—

(i) regulation 5 of the Accession (Immigration and Worker Registration) Regulations 2004 ( 9 ) (application of the 2006 Regulations in relation to a national of the Czech Republic, Estonia, Latvia, Lithuania, Hungary, Poland, Slovenia or the Slovak Republic who is an “accession State worker requiring registration”), or

(ii) regulation 6 of the Accession (Immigration and Worker Authorisation) Regulations 2006 ( 10 ) (right of residence of a Bulgarian or Romanian who is an “accession State national subject to worker authorisation”); .

Amendment of the Jobseeker’s Allowance Regulations 1996

3. —(1)The Jobseeker’s Allowance Regulations 1996( 11 ) are amended as follows.

(2) In regulation 85A(4) (special cases: supplemental – persons from abroad), for sub-paragraph (f) substitute—

(f) a person who is treated as a worker for the purpose of the definition of “qualified person” in regulation 6(1) of the Immigration (European Economic Area) Regulations 2006 pursuant to—

(i) regulation 5 of the Accession (Immigration and Worker Registration) Regulations 2004 ( 12 ) (application of the 2006 Regulations in relation to a national of the Czech Republic, Estonia, Latvia, Lithuania, Hungary, Poland, Slovenia or the Slovak Republic who is an “accession State worker requiring registration”), or

(ii) regulation 6 of the Accession (Immigration and Worker Authorisation) Regulations 2006 ( 13 ) (right of residence of a Bulgarian or Romanian who is an “accession State national subject to worker authorisation”); .

Amendment of the State Pension Credit Regulations 2002

4. —(1)The State Pension Credit Regulations 2002( 14 ) are amended as follows.

(2) In regulation 2(4) (persons not in Great Britain), for sub-paragraph (f) substitute—

(f) a person who is treated as a worker for the purpose of the definition of “qualified person” in regulation 6(1) of the Immigration (European Economic Area) Regulations 2006 pursuant to—

(i) regulation 5 of the Accession (Immigration and Worker Registration) Regulations 2004 ( 15 ) (application of the 2006 Regulations in relation to a national of the Czech Republic, Estonia, Latvia, Lithuania, Hungary, Poland, Slovenia or the Slovak Republic who is an “accession State worker requiring registration”), or

(ii) regulation 6 of the Accession (Immigration and Worker Authorisation) Regulations 2006 ( 16 ) (right of residence of a Bulgarian or Romanian who is an “accession State national subject to worker authorisation”); .

Amendment of the Housing Benefit Regulations 2006

5. —(1)The Housing Benefit Regulations 2006( 17 ) are amended as follows.

(2) In regulation 10(3B) (persons from abroad), for sub-paragraph (f) substitute—

(f) a person who is treated as a worker for the purpose of the definition of “qualified person” in regulation 6(1) of the Immigration (European Economic Area) Regulations 2006 pursuant to—

(i) regulation 5 of the Accession (Immigration and Worker Registration) Regulations 2004 ( 18 ) (application of the 2006 Regulations in relation to a national of the Czech Republic, Estonia, Latvia, Lithuania, Hungary, Poland, Slovenia or the Slovak Republic who is an “accession State worker requiring registration”), or

(ii) regulation 6 of the Accession (Immigration and Worker Authorisation) Regulations 2006 ( 19 ) (right of residence of a Bulgarian or Romanian who is an “accession State national subject to worker authorisation”); .

Amendment of the Housing Benefit (Persons who have attained the qualifying age for state pension credit) Regulations 2006

6. —(1)The Housing Benefit (Persons who have attained the qualifying age for state pension credit) Regulations 2006( 20 ) are amended as follows.

(2) In regulation 10(4A) (persons from abroad), for sub-paragraph (f) substitute—

(f) a person who is treated as a worker for the purpose of the definition of “qualified person” in regulation 6(1) of the Immigration (European Economic Area) Regulations 2006 pursuant to—

(i) regulation 5 of the Accession (Immigration and Worker Registration) Regulations 2004 ( 21 ) (application of the 2006 Regulations in relation to a national of the Czech Republic, Estonia, Latvia, Lithuania, Hungary, Poland, Slovenia or the Slovak Republic who is an “accession State worker requiring registration”), or

(ii) regulation 6 of the Accession (Immigration and Worker Authorisation) Regulations 2006 ( 22 ) (right of residence of a Bulgarian or Romanian who is an “accession State national subject to worker authorisation”); .

Amendment of the Council Tax Benefit Regulations 2006

7. —(1)The Council Tax Benefit Regulations 2006( 23 ) are amended as follows.

(2) In regulation 7(4A) (persons from abroad), for sub-paragraph (f) substitute—

(f) a person who is treated as a worker for the purpose of the definition of “qualified person” in regulation 6(1) of the Immigration (European Economic Area) Regulations 2006 pursuant to—

(i) regulation 5 of the Accession (Immigration and Worker Registration) Regulations 2004 ( 24 ) (application of the 2006 Regulations in relation to a national of the Czech Republic, Estonia, Latvia, Lithuania, Hungary, Poland, Slovenia or the Slovak Republic who is an “accession State worker requiring registration”), or

(ii) regulation 6 of the Accession (Immigration and Worker Authorisation) Regulations 2006 ( 25 ) (right of residence of a Bulgarian or Romanian who is an “accession State national subject to worker authorisation”); .

Amendment of the Council Tax Benefit (Persons who have attained the qualifying age for state pension credit) Regulations 2006

8. —(1)The Council Tax Benefit (Persons who have attained the qualifying age for state pension credit) Regulations 2006( 26 ) are amended as follows.

(2) In regulation 7(4A) (persons from abroad), for sub-paragraph (f) substitute—

(f) a person who is treated as a worker for the purpose of the definition of “qualified person” in regulation 6(1) of the Immigration (European Economic Area) Regulations 2006 pursuant to—

(i) regulation 5 of the Accession (Immigration and Worker Registration) Regulations 2004 ( 27 ) (application of the 2006 Regulations in relation to a national of the Czech Republic, Estonia, Latvia, Lithuania, Hungary, Poland, Slovenia or the Slovak Republic who is an “accession State worker requiring registration”), or

(ii) regulation 6 of the Accession (Immigration and Worker Authorisation) Regulations 2006 ( 28 ) (right of residence of a Bulgarian or Romanian who is an “accession State national subject to worker authorisation”); .

Section 137(1) is cited because of the meaning given to the word “prescribed”. Section 175(1) and (3) is applied to provisions of the State Pension Credit Act 2002 (c.16) by section 19(1) of that Act.
