The First Secretary of State makes the following Order in exercise of the powers conferred by section 1 of the Regulatory Reform Act 2001( 1 ).
The First Secretary of State is of the opinion that this Order does not remove any necessary protection or prevent any person from continuing to exercise any right or freedom which he might reasonably expect to continue to exercise.
This Order makes only provision which modifies a subordinate provision of the Regulatory Reform (Fire Safety) Order 2005( 2 ).
Citation, commencement and extent
1. —(1) This Order may be cited as the Regulatory Reform (Fire Safety) Subordinate Provisions Order 2006 and shall come into force on 31st March 2006.
(2) This Order extends to England and Wales only.
Modification of commencement date
2. In article 1(3) of the Regulatory Reform (Fire Safety) Order 2005 for “1st April 2006” substitute “1st October 2006”.

S.I. 2005/1541 . Article 52(1)(a) of the Regulatory Reform (Fire Safety) Order 2005 designates article 1(3) of that Order as a subordinate provision for the purposes of section 4 of the Act and article 52(2) provides that a subordinate provisions order made in relation to article 1(3) shall be subject to annulment in pursuance of a resolution of either House of Parliament.
