The Secretary of State for Education and Skills makes the following Regulations in exercise of the powers conferred by sections 12(2), 15(3), 16(3) and 118(5) and (6) of the Care Standards Act 2000( 1 ) and section 86(1) of the Health and Social Care (Community Health and Standards) Act 2003( 2 ):β€”

Citation, commencement, application and interpretation

1. β€”(1) These Regulations may be cited as the National Care Standards Commission (Commission for Social Care Inspection) (Fees) (Adoption Agencies, Adoption Support Agencies and Local Authority Fostering Functions) (Amendment) Regulations 2006 and shall come into force on 1st April 2006.

(2) These Regulations apply to England only.

(3) In these Regulations, β€œthe principal Regulations” means the National Care Standards Commission (Fees and Frequency of Inspections) (Adoption Agencies) Regulations 2003( 3 ).

Amendment of regulation 3 of the principal Regulations

2.Regulation 3 of the principal Regulations (voluntary adoption agencies - registration fees) is amended as followsβ€”

(a) in paragraph (1)(a), for β€œΒ£1,320” substitute β€œΒ£1,518”;

(b) in paragraph (1)(b)(i), for β€œΒ£1,320” substitute β€œΒ£1,518”;

(c) in paragraph (1)(b)(ii), for β€œΒ£360” substitute β€œΒ£414”;

(d) in paragraph (2)(a), for β€œΒ£360” substitute β€œΒ£414”;

(e) in paragraph (2)(b)(i), for β€œΒ£1,320” substitute Β£1,518β€œ;

Amendment of regulation 3A of the principal Regulations

3.Regulation 3A of the principal Regulations (adoption support agencies – registration fees) is amended as followsβ€”

(b) in paragraph (1)(b), for β€œΒ£360” substitute β€œΒ£414”;

5.Regulation 4A of the principal Regulations (adoption support agencies – variation fees) is amended as followsβ€”

6.Regulation 5 of the principal Regulations (annual fees – voluntary adoption agencies) is amended as followsβ€”

Amendment of regulation 5A of the principal Regulations

7.Regulation 5A of the principal Regulations (annual fees – adoption support agencies) is amended as followsβ€”

(a) in paragraph (1), for β€œΒ£600” substitute β€œΒ£690”;

(b) in paragraph (2), for β€œΒ£300” substitute β€œΒ£345”.

Annual fees – local authority adoption and fostering functions

8. After regulation 5A insert the following regulationβ€”

β€œ 5B. β€” For the purposes of section 86(1) (fees) of the Health and Social Care (Community Health and Standards) Act 2003 (β€œthe 2003 Act ”) the prescribed functions of the Commission are its functions under section 79 or 80 of the 2003 Act in relation to the functions of a local authority referred to in section 43(3)(a) ( 4 ) and (b) of the Act (relevant adoption and fostering functions). ” .

The powers are exercisable by the appropriate Minister, who is defined in section 121(1) of the Care Standards Act 2000 (β€œthe Act”) in relation to England as the Secretary of State. β€œPrescribed” and β€œregulations” are defined in section 121(1) of the Act. The functions of the National Care Standards Commission under Part 2 of the Act transferred to the Commission for Social Care Inspection in accordance with section 102(3) of the Health and Social Care (Community Health and Standards) Act 2003 (c. 43) with effect from 1 st April 2004.
