Citation and commencement
1. This Order may be cited as the Local Elections (Principal Areas) (Welsh Forms) Order 2007 and shall come into force on 27 March 2007.
Revocation
2. The following Orders are revoked—
(a) the Local Elections (Principal Areas) (Welsh Forms) Order 1987( 3 );
(b) the Elections (Welsh Forms) Order 1995( 4 );
(c) the Elections (Welsh Forms) Order 2001( 5 );and
(d) the Local Elections (Principal Areas) (Welsh Forms) Order 2004( 6 ).
Interpretation
3. In this Order—
“the 2006 Rules” means the Local Elections (Principal Areas) (England and Wales) Rules 2006( 7 );
“community council election” means an election conducted under the Local Elections (Parishes and Communities) (England and Wales) Rules 2006( 8 );
“elected mayor” has the same meaning as in section 39 of the Local Government Act 2000( 9 );
“European Parliamentary election” shall have the same meaning as in section 27(1) of the Representation of the People Act 1985( 10 );
“mayoral election” means an election conducted in accordance with rules made under section 44 of the Local Government Act 2000 for the return of an elected mayor;
“principal area election” means any election of councillors conducted under the 2006 Rules in Wales;
“relevant election or referendum” means one or more of the following—
a Parliamentary election;
a European Parliamentary election;
a community council election;
a mayoral election; and
a referendum,
the poll at which is taken together with the poll at a principal area election; and
“referendum” means a referendum conducted in accordance with regulations made under section 45 of the Local Government Act 2000.
Welsh versions of forms of words
4. —(1) The following form of words: “PEIDIWCH A PHLEIDLEISIO DROS RAGOR NA(G)………..YMGEISYDD”, is prescribed as the form of words in Welsh for the words: “VOTE FOR NO MORE THAN ………..CANDIDATES”, which are specified in the forms of front of ballot paper in the Appendices to Schedules 2 and 3 to the 2006 Rules.
(2) The form of words in Welsh prescribed by paragraph (1) shall be printed so that they appear immediately beneath the corresponding words in English on every ballot paper at any principal area election.
(3) “Annibynnwr” is prescribed as the form of words in Welsh for the word “Independent” which is specified for use as the description of a candidate in a nomination paper by rule 4(4)(b)( 11 ) of the rules in Schedules 2 and 3 to the 2006 Rules.
(4) The word in Welsh prescribed by paragraph (3) above may be used as well as or in place of the equivalent word in English at a principal area election.

5. The form set out in Schedule 1 to this Order is prescribed as the version partly in Welsh and partly in English, of the form of back of ballot paper in the Appendices to Schedules 2 and 3 of the 2006 Rules, which must be used at any principal area election.
Welsh versions of forms and a form of words for use at polls taken alone
6. Each of the forms listed in subparagraphs (a) to (e) and set out in Schedule 2 to this Order is prescribed as the Welsh version which may be used at a principal area election in place of—
(a) in the case of form 1, the questions set out in the table in rule 33 of the 2006 Rules;
(b) in the case of form 2, the form of nomination paper set out in the Appendix to Schedule 2 to the 2006 Rules;
(c) in the case of form 3, the form of candidate’s consent to nomination set out in the Appendix to Schedule 2 to the 2006 Rules;
(d) in the case of form 4, the form of directions for the guidance of the voters in voting in the Appendix to Schedule 2 to the 2006 Rules; and
(e) in the case of form 5, and the form of declaration to be made by the companion of a voter with disabilities in the Appendix to Schedule 2 to the 2006 Rules.

7. —(1) Each of the forms listed in subparagraphs (a) to (h) and set out in Schedule 3 to this Order is prescribed as the version partly in Welsh and partly in English, of the forms in the Appendix to Schedule 2 to the 2006 Rules, which must be used at a principal area election in place of—
(a) in the case of form 1, the corresponding number list (L1);
(b) in the case of form 2, the corresponding number lists (L2);
(c) in the case of form 3, the form of postal voting statement;
(d) in the case of form 4, the official poll card;
(e) in the case of form 5, the official postal poll card;
(f) in the case of form 6, the official proxy poll card;
(g) in the case of form 7, the official proxy postal poll card; and
(h) in case of form 8, form of certificate of employment.
(2) Form 9 is prescribed as the form of words partly in Welsh and partly in English which must be used at a principal area election in place of the words of the notice prescribed by rule 26(8) of Schedule 2 to the 2006 Rules.

8. Each of the forms listed in subparagraphs (a) to (e) and set out in Schedule 4 to this Order is prescribed as the Welsh version which may be used at a principal area election taken with a relevant election or referendum in place of—
(a) in the case of form 1, the questions set out in the table in rule 33 of the 2006 Rules;
(b) in the case of form 2, the form of nomination paper set out in the Appendix to Schedule 3 to the 2006 Rules;
(c) in the case of form 3, the form of candidate’s consent to nomination set out in the Appendix to Schedule 3 to the 2006 Rules;
(d) in the case of form 4, the form of directions for the guidance of the voters in voting in the Appendix to Schedule 3 to the 2006 Rules; and
(e) in the case of form 5, the form of declaration to be made by the companion of a voter with disabilities in the Appendix to Schedule 3 to the 2006 Rules.

9. —(1) Each of the forms listed in subparagraphs (a) to (i) and set out in Schedule 5 to this Order is prescribed as the version partly in Welsh and partly in English, of the forms in the Appendix to Schedule 3 to the 2006 Rules, which must be used at a principal area election taken with a relevant election or referendum in place of—
(a) in the case of form 1, the corresponding number list (M1);
(b) in the case of form 2, the corresponding number lists (M2);
(c) in the case of form 3, the form of postal voting statement (for use where there is a joint issue and receipt of postal ballot papers);
(d) in the case of form 4, the form of postal voting statement (for use when a local government poll is combined with another poll but the postal ballot papers are not combined);
(e) in the case of form 5, the official poll card;
(f) in the case of form 6, the official postal poll card;
(g) in the case of form 7, the official proxy poll card;
(h) in the case of form 8, the official proxy postal poll card; and
(i) in case of form 9, form of certificate of employment.
(2) Form 10 is prescribed as the form of words partly in Welsh and partly in English which must be used at a principal area election taken with a relevant election or referendum in place of the words of the notice prescribed by rule 26(8) in Schedule 3 to the 2006 Rules.
Variations
10. With the exception of form 1 in Schedules 2 and 4 to this Order, the forms prescribed by this Order may be used with such adaptations as the circumstances may require.
