The Housing Act 2004 (Commencement No. 7) (England) Order 2007

The Secretary of State, in exercise of the powers conferred by sections 270(4) and (5)(a), (c), (d) and (f) of the Housing Act 2004( 1 ), makes the following Order:
Citation and application
1. β(1) This Order may be cited as the Housing Act 2004 (Commencement No. 7) (England) Order 2007.
(2) This Order applies in relation to England only.
Commencement
2. The following provisions of the Housing Act 2004 shall come into force on 6th April 2007β
(a) in so far as they are not already in force( 2 ), sections 53, 212 to 215 and Schedule10;
(b) section 266 in so far as it relates to the repeals inβ
(i) the London Building Acts (Amendment) Act 1939( 3 );
(ii) the County of Merseyside Act 1980( 4 );
(iii) the Building Act 1984( 5 ); and
(iv) the Leicestershire Act 1985( 6 ).

2004 c.34 . The powers conferred by sections 270(4) and (5) are exercisable, as respects England, by the Secretary of State and, as respects Wales, by the National Assembly for Wales. See the definition of the appropriate national authority in section 261(1) of the Housing Act 2004.
So far as a provision of the Housing Act 2004 Act confers a power to make an order or regulations exercisable by the Secretary of State it came into force on the passing of that Act by virtue of section 270(s)(b) of the Act. Section 266 has already been brought into force partially by an earlier commencement order. (See SI 2006/1060 .)
