The Secretary of State for Education and Skills makes the following Regulations in exercise of the powers conferred by sections 21(9) and 138 of the School Standards and Framework Act 1998( 1 ).
Citation, commencement and application
1. —(1) These Regulations may be cited as the School Organisation (Foundation Special Schools) (Application of Provisions Relating to Foundations) (England) Regulations 2007 and come into force on 25th May 2007.
(2) These Regulations apply only in relation to England.
Application and modification of provisions relating to foundations
2.Section 21(3) of the School Standards and Framework Act 1998 applies to foundation special schools as it applies in relation to foundation and voluntary schools with the following modifications—
(a) in paragraph (a) omit sub-paragraph (ii); and
(b) in paragraph (b) omit sub-paragraph (ii).
