The Drivers’ Hours (Goods Vehicles) (Milk Collection) (Temporary Exemption) Regulations 2007

The Secretary of State makes the following Regulations, in exercise of the powers conferred by section 96(10) of the Transport Act 1968( 1 ), now vested in her ( 2 ).
The Secretary of State has consulted with such representative organisations as she has seen fit, in accordance with section 101(6) of the Act.
Citation, commencement and interpretation
1. —(1) These Regulations may be cited as The Drivers’ Hours (Goods Vehicles) (Milk Collection) (Temporary Exemption) Regulations 2007 and shall come into force on 11 August 2007.
(2) In these Regulations—
“the Act” means Transport Act 1968.
Temporary exemption
2. Where the driver of any goods vehicle engaged in the collection and transportation of milk meets at least one of the conditions in Regulation 3, the Act shall have effect as if for “eleven hours” in section 96(3)(a) there was substituted “thirteen hours”.
3. The conditions referred to in Regulation 2 are that the driver spends time driving or on duty during any working day either—
(a) to meet special needs occasioned by the outbreak of foot-and-mouth disease in Great Britain (“the outbreak”), or
(b) to deal with effects or consequences of the outbreak.
