The Secretary of State makes the following Regulations in exercise of the powers conferred by section 60 of the Police Act 1996(1).

In accordance with section 60(4) of that Act, the Secretary of State has consulted the three Central Committees of the Police Federation for England and Wales sitting together as a Joint Committee.

Citation, commencement and extentI1

1.—(1) These Regulations may be cited as the Police Federation (Amendment) Regulations 2007 and shall come into force on 15th October 2007.

(2) These Regulations extend to England and Wales.

Amendment to the Police Federation Regulations 1969I2

2.—(1) The Police Federation Regulations 1969(2) are amended as follows.

(2) For regulation 16(4) (subscriptions etc) substitute—

(4) If at the end of any year the funds held by a branch board exceed—

(a)£1,800 where the number of subscribing members is less than a hundred;

(b)£18 for each subscribing member, where the number of such members is a hundred or more but less than five hundred or, in the case of the metropolitan police force, a hundred or more but less than one thousand;

(c)£9,000 where the number of subscribing members is five hundred or more or, in the case of the metropolitan police force, £18,000 where the number of such members is one thousand or more,

the board may pay such amount of the excess as they think fit to the joint branch board and shall pay the remainder of the excess (if any) to the appropriate central committee..

3. Regulation 3 of the Police Federation (Amendment) Regulations 1975(3) is revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Police Federation Regulations 1969 by substituting a new regulation 16(4). Under the previous regulation 16(4), where a branch board of the Police Federation held funds exceeding specified amounts at the end of any year, the board was required to pay the excess to the appropriate central committee and, after making such payment, it was permitted to pay such sum as it thought fit to the joint branch board.

The new regulation 16(4) revises the amounts specified in the previous regulation. It also amends the provision setting out how a branch board is to use funds it holds at the end of any year in excess of the revised specified amounts. The board may pay such amount of the excess as it thinks fit to the joint branch board and shall pay any amount remaining of the excess to the appropriate central committee.

These regulations revoke regulation 3 of the Police Federation (Amendment) Regulations 1975, which also substituted a new regulation 16(4) in the Police Federation Regulations 1969.
