The Secretary of State, in exercise of the powers conferred by section 95 of the Local Government Act 2003( 1 ), makes the following Order:

Citation and commencement

1. This Order may be cited as the Local Government (Best Value Authorities) (Power to Trade) (England) (Amendment) Order 2007 and shall come into force on 1st April 2007.

Amendment of the Local Government (Best Value Authorities) (Power to Trade) (England) Order 2004

2.The Local Government (Best Value Authorities) (Power to Trade) (England) Order 2004( 2 ) is amended as follows.

Fire and rescue Authorities

3. —(1) In the entry for Devon Fire Authority in the Schedule (fire and rescue authorities to which article 4 applies and services that may be provided for a commercial purpose), for “Devon Fire Authority” substitute “Devon and Somerset Fire and Rescue Authority”.

(2) In the Schedule omit the entry for Somerset County Council.
