The Milk (Cessation of Production) (Revocation) Scheme 2007

The Secretary of State, in exercise of the powers conferred by section 1 of the Milk (Cessation of Production) Act 1985( 1 ), makes the following Scheme:

Title and commencement

1. This Scheme may be cited as the Milk (Cessation of Production) (Revocation) Scheme 2007 and comes into force on 6th April 2007.

Revocations

2. —(1) The following Schemes are revoked in relation to England only—

(a) the Milk (Partial Cessation of Production) (England and Wales) Scheme 1986( 2 ); and

(b) the Milk (Cessation of Production) (England and Wales) Scheme 1987( 3 ).

(2) The following Schemes are revoked—

(a) the Milk (Partial Cessation of Production) (Scotland) Scheme 1986( 4 ); and

(b) the Milk (Cessation of Production) (Scotland) Scheme 1987( 5 ).

1985 c. 4 . Section 5 defines the Minister. The functions of the Minister of Agriculture, Fisheries and Food were transferred to the Secretary of State by virtue of article 2(2) of S.I. 2002/794 . The Secretary of State’s power to make a Scheme which extends to Scotland remains exercisable by virtue of section 57(1) of the Scotland Act 1998 (c. 46) .
