This Order is made in exercise of the powers conferred by section 89(3) of the Traffic Management Act 2004( 1 ), and by paragraph 8(1) of Schedule 8 and paragraph 3(1) of Schedule 10 to that Act.
Cornwall County Council has applied to the Secretary of State for an order to be made under these powers with respect to the County of Cornwall.
The Secretary of State has consulted the chief officer of the Devon and Cornwall Constabulary in accordance with the requirements of paragraphs 8(3) of Schedule 8 and 3(4) of Schedule 10.
Accordingly, the Secretary of State for Transport( 2 ) makes this Order:
Citation and commencement
1. This Order may be cited as the Civil Enforcement of Parking Contraventions (County of Cornwall) Designation Order 2008 and shall come into force on 5th May 2008.
Designation of civil enforcement area and special enforcement area
2. —(1) Subject to paragraph (2), the Secretary of State designates the County of Cornwall as—
(a) a civil enforcement area for parking contraventions; and
(b) a special enforcement area.
(2) This Order will not apply to parking contraventions in relation to parking places provided or authorised under section 32(1)(a) or (b) of the Road Traffic Regulation Act 1984( 3 ) by any of the councils for the following districts—
(a) North Cornwall;
(b) Penwith;
(c) Carradon; and
(d) Kerrier.

The Secretary of State is the “appropriate national authority” for England for the purposes of Part 6 of the Traffic Management Act 2004 under section 92 of that Act.
