The Local Government and Public Involvement in Health Act 2007 (Commencement No. 6 and Transitional and Saving Provision) Order 2008

The Secretary of State, in exercise of the powers conferred by sections 245(5) and (6) of the Local Government and Public Involvement in Health Act 2007( 1 ), makes the following Order.
Citation
1. This Order may be cited as the Local Government and Public Involvement in Health Act 2007 (Commencement No. 6 and Transitional and Saving Provision) Order 2008.
Provisions coming into force on 8th May 2008
2. Subject to article 3, the following provisions of the Local Government and Public Involvement in Health Act 2007 shall come into force on 8th May 2008โ
(a) section 185 (assessment of allegations) so far as not already in force; and
(b) section 186 (information to be provided to Standards Board by relevant authority).
Transitional and saving provision
3.Section 58 of the Local Government Act 2000, the Relevant Authorities (Standards Committee) Regulations 2001( 2 ), and the Local Authorities (Code of Conduct) (Local Determination) Regulations 2003( 3 ) as they stand immediately before 8th May 2008, shall continue to have effect in relation to any allegation in writing received by the Standards Board for England( 4 ) before 8th May 2008 that a member or co-opted member (or former member or former co-opted member) of a relevant authority in England has failed, or may have failed, to comply with the authorityโs code of conduct.

SI 2003/1483 ; regulation 2 and regulations 4 to 7 were amended by the Local Authorities (Code of Conduct) (Local Determination) (Amendment) Regulations 2004 ( SI 2004/2617 ).
The Standards Board for England is constituted under section 57 of the Local Government Act 2000.
