The Secretary of State for Innovation, Universities and Skills makes the following Order in exercise of the powers conferred by section 27 of the Further and Higher Education Act 1992( 1 ) (βthe Actβ).
The Order is made with the consent of the further education corporation known as the Manchester College( 2 ). It is made for the purpose of giving effect to a proposal for the dissolution of the further education corporations known as Manchester College of Arts and Technology( 3 ) and City College, Manchester( 4 ) (βthe corporationsβ) made by the Learning and Skills Council for England. The Secretary of State has consulted each of the corporations.
1. This Order may be cited as the Manchester College of Arts and Technology and City College, Manchester (Dissolution) Order 2008 and comes into force on 1st August 2008.
2. On 1st August 2008 each of the corporations shall be dissolved and all of their property, rights and liabilities shall be transferred to the Manchester College, being a body corporate established for purposes which include the provision of educational facilities or services.
3. Section 26(2), (3) and (4) of the Act shall apply to any person employed by any of the corporations immediately before 1st August 2008 as if the references in that sectionβ
(a) to a person to whom that section applies were to a person so employed;
(b) to the operative date were to 1st August 2008;
(c) to the transferor were to the corporation in question; and
(d) to the corporation were to the Manchester College.
