The Secretary of State for Children, Schools and Families makes the following Order in exercise of the powers conferred by section 123(4)(a) of the Education Act 2002( 1 ):

Citation, commencement and application

1. —(1) This Order may be cited as the School Teachers’ Incentive Payments (England) Order 2008 and comes into force on 1st September 2008.

(2) This Order applies only in relation to school teachers in England.

Interpretation

2. In this Order—

accredited module” means a module on the relevant course which meets specific academic standards laid down by the provider of the course;

authority” means a local education authority in England;

relevant course” means one of the following courses—

(a)

“the Mathematics Development Programme for Teachers” provided by Liverpool Hope University, the University of Brighton or the University of Wolverhampton;

(b)

“the Science Additional Specialism Programme (Chemistry)” or “the Science Additional Specialism Programme (Physics)” provided by Edge Hill University in conjunction with the University of Cumbria, Keele University in conjunction with the West Midlands Science Learning Centre, or the University of Brighton;

relevant post” means a permanent post or a post for a fixed term of at least one term in a school maintained by an authority in which the post holder is required to teach the subject which is the subject of the relevant course completed by that person.

Incentive payments to school teachers

3. A lump sum payment made by an authority or the governing body of a school maintained by an authority to a school teacher on taking up or remaining in a relevant post, in consideration of the teacher’s successful completion of a relevant course and an accredited module on that course, is not to be treated as remuneration for the purpose of section 122(1) of the Education Act 2002.
