The Secretary of State for Children, Schools and Families makes the following Regulations in exercise of the powers conferred by sections 537A(1) and 569(4) of the Education Act 1996( 1 ):
Citation, commencement and application
1. —(1) These Regulations may be cited as the Education (Information About Individual Pupils) (England) (Amendment) Regulations 2008 and come into force on 1st January 2009.
(2) These Regulations apply only in relation to schools in England.
Amendment of the Education (Information About Individual Pupils) (England) Regulations 2006
2. —(1)The Education (Information About Individual Pupils) (England) Regulations 2006( 2 ) are amended as follows.
(2) In regulation 2 (interpretation)—
(a) at the end of the definition of “unauthorised absence”, omit “and”; and
(b) after the definition of “unauthorised absence”, insert—
“ “unique learner number”, in relation to a registered pupil at a school, means the specific combination of numbers allocated to the pupil by the Learning and Skills Council for England as that pupil’s unique learner number; and ” .
(3) In Part 1 of Schedule 1 (all pupils on the school register)—
(a) at the end of sub-paragraph 2(j) omit “and”;
(b) at the end of sub-paragraph 2(k) insert “and”; and
(c) after sub-paragraph 2(k), insert—
“ (l) unique learner number, where known. ” .

1996 c. 56 . Section 537A was inserted by the Education Act 1997 (c. 44) , section 20, and substituted by the School Standards and Framework Act 1998 (c. 31) , Schedule 30, paragraph 153. By virtue of the National Assembly for Wales (Transfer of Functions ) Order 1999 ( S.I. 1999/672 ), the powers conferred by that section are exercisable by the Secretary of State in relation to England. See section 579(1) for the definitions of “prescribed” and “regulations”.
