The Registrar General for England and Wales, in exercise of the power conferred by section 13(1)(d) of the Police and Justice Act 2006( 1 ) with the approval of the Chancellor of the Exchequer, makes the following Order:

Citation commencement and interpretation

1. โ€”(1) This Order may be cited as the Supply of Information (Register of Deaths) (England and Wales) Order 2008 and shall come into force on 25th March 2008 .

(2) In this Order โ€œinsurerโ€ means a person who has permission under Part IV of the Financial Services and Markets Act 2000( 2 ) to effect or carry out contracts of insurance.

(3) The definition of insurer in paragraph (2) must be read with โ€”

(a) section 22 of the Financial Services and Markets Act 2000;

(b) any relevant order under that section; and

(c) Schedule 2 to the Act.

Revocation

2.The Supply of Information (Register of Deaths) Regulations 2007( 3 ) are revoked.

Disclosure of information

3. The Registrar General for England and Wales may supply information contained in any register of deaths kept by her to a person or body specified, or of a description specified, in the Schedule to this Order for use in the prevention, detection, investigation or prosecution of offences.

SCHEDULE

1. A local authority within the meaning of the Local Government Act 1972( 4 ).

2. The Council of the Isles of Scilly.

3. A council within the meaning of the Local Government etc. (Scotland) Act 1994( 5 ).

4. A district council within the meaning of the Local Government Act (Northern Ireland) 1972( 6 ).

5. A government department.

6. The Scottish Executive.

7. The Northern Ireland departments.

8. A credit reference agency.

9. A building society within the meaning of the Building Societies Act 1986( 7 ).

10. An insurer.

11. A person who holds a licence under the Consumer Credit Act 1974( 8 ).

12. A bank as defined in the Bankersโ€™ Books Evidence Act 1879( 9 ).

13. The trustees or managers of a pension scheme.

14. A person who, or body which, updates lists so as to remove the entries on those lists of persons who are deceased.

15. A body established by an Act of Parliament or by a statutory instrument made under an Act of Parliament to perform functions conferred on it under or by that Act or instrument.

16. An NHS body within the meaning of the National Health Service Act 2006( 10 ).

17. An NHS body within the meaning of the National Health Service (Wales) Act 2006( 11 ).

18. The Common Council of the City of London.

19. A person who has been authorised to exercise a function of an office-holder or Minister in accordance with section 69 of the Deregulation and Contracting Out Act 1994( 12 ).

20. A person who has been authorised to exercise a function of a local authority in accordance with section 70 of the Deregulation and Contracting Out Act 1994.
