The Secretary of State, in exercise of the powers conferred by section 206(2) of the Communications Act 2003( 1 ), makes the following Order:
Citation and commencement
1. This Order may be cited as the S4C (Investment Activities) Approval Order 2008 and comes into force on 2 nd April 2008.
Interpretation
2. In this Orderβ
βthe Actβ means the Communications Act 2003;
βthe Companyβ means the company which is incorporated in England and Wales with registered number 05267418 and which, at the date on which this Order is made, is called Inuk Networks Limited;
βassociateβ means, in relation to the Company, any subsidiary undertaking or parent undertaking of the Company or any subsidiary undertaking of such parent undertaking from time to time;
βparent undertakingβ and βsubsidiary undertakingβ have the meaning given to them by section 1162, together with Schedule 7, of the Companies Act 2006( 2 ).
Approval of investment activities
3. For the purposes of section 206(2) of the Act the activities ofβ
(a) acquiring, holding and turning to account from time to time any interest in the shares, stocks or other securities from time to time of the Company or any associate of the Company;
(b) providing loans or any other form of finance to the Company or any associate of the Company;
(c) disposing of, or dealing with, any interest in any shares, stocks or securities referred to in sub-paragraph (a) or in loans or the other forms of finance referred in sub-paragraph (b); and
(d) entering into, or having the benefit of, any form of agreement, instrument or arrangement in connection with (a), (b) or (c) above
are approved to the extent that such activities are authorised, and authorised only, by section 206(1) of the Act.

2003 c. 21 . Section 206(3) requires that an approval given by the Secretary of State under section 206(2) must be contained in an Order.
