The Asylum Support (Amendment) (No. 2) Regulations 2009

The Secretary of State, in exercise of the powers conferred by section 166(3) of, and paragraphs 1 and 3(a) of Schedule 8 to, the Immigration and Asylum Act 1999( 1 ), makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Asylum Support (Amendment) (No. 2) Regulations 2009 and shall come into force on the 6th July 2009.

Kind and levels of support for essential living needs

2. —(1)The Asylum Support Regulations 2000( 2 ) are amended as follows.

(2) For the table at regulation 10(2) of the Asylum Support Regulations 2000 substitute -

Table

Qualifying couple £69.57
Lone parent aged 18 or over £42.16
Single person aged 25 or over, excluding lone parent (where the decision to grant support is made prior to the 5 th October 2009 and the person has or will have reached age 25 prior to that date) £42.16
Any other single person aged 18 or over, excluding lone parent £35.13
Person aged at least 16 but under 18 (except a member of a qualifying couple) £38.18
Person aged under 16 £50.81 .

(3) After paragraph (3), insert –

(3A) For the purposes of the table at regulation 10(2), a decision to grant support is made on the date recorded on the letter granting asylum support to the applicant. .

Revocation of the Asylum Support (Amendment) Regulations 2008

3.The Asylum Support (Amendment) Regulations 2008 are revoked.
