The Criminal Justice and Immigration Act 2008 (Commencement No. 6 and Transitional Provisions) Order 2009

The Secretary of State, in exercise of the powers conferred by section 153(7) and (8) of the Criminal Justice and Immigration Act 2008( 1 ), makes the following Order:

Citation

1. This Order may be cited as the Criminal Justice and Immigration Act 2008 (Commencement No. 6 and Transitional Provisions) Order 2009.

Appointed Date

2. The date appointed for the coming into force of the following provisions of the Criminal Justice and Immigration Act 2008 is 1 st February 2009 -

(a) section 48 (1)(a) (the giving of youth conditional cautions);

(b) section 123 (Review of anti-social behaviour orders etc. );

(c) section 124 (Individual support orders);

(d) section 148(2) (Consequential etc. amendments and transitional and saving provisions) in so far as it relates to the provisions specified in paragraph (f);

(e) in Schedule 9 (Alternatives to prosecution for offenders under 18)

(i) paragraph 1;

(ii) paragraph 3 but only to the extent that it inserts sections 66G and 66H of the Crime and Disorder Act 1998( 2 );

(iii) paragraph 4; and

(f) paragraphs 33 and 34 of Schedule 27 (Transitory, transitional and saving provisions).
